These Terms govern your use of GetInstaLead (the "Service"), operated by Ekamra Labs, India.
By creating an account you agree to these Terms. If you do not agree, do not use the Service.
GetInstaLead connects to your Instagram Business account and uses artificial intelligence to respond to direct messages and comments on your behalf, qualify prospective clients through conversation, and schedule calls on your calendar. It may send appointment confirmations and reminders via WhatsApp where the recipient opts in.
You must be at least 18 and able to enter a binding contract. You must operate a legitimate business and hold an Instagram Business or Creator account you are authorised to connect.
You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Notify us promptly at support@getinstalead.com of any unauthorised use.
You are responsible for the content of conversations conducted on your behalf. The Service acts as your agent. You configure what it says about your programs, your pricing, and your qualification criteria.

Violation may result in immediate suspension without refund.
The Service includes safety controls that cannot be disabled or overridden by configuration.
These apply to every account regardless of industry. The AI will not:
Additional controls apply based on the industry you select at signup. Where your industry carries specific regulatory risk, further restrictions are applied automatically. If you do not select an industry, the most restrictive applicable set is used.
Conversations meeting these criteria are ended and escalated to you.
You acknowledge these controls are a core part of the Service. Requests to remove or weaken them will be declined, and attempting to circumvent them is a material breach of these Terms.
The Service uses AI to generate messages. AI output can be unpredictable and may occasionally be inaccurate or inappropriate despite our controls.
You acknowledge that:
Every conversation discloses to the recipient that they are speaking with an AI assistant. You may not remove or obscure this disclosure.
The Service depends on Meta's Instagram and WhatsApp platforms. We do not control those platforms. Meta may change its APIs, policies, pricing, or availability at any time, which may affect or interrupt the Service.
We are not liable for any suspension, restriction, or termination of your Instagram or WhatsApp account by Meta. You remain responsible for complying with Meta's terms.
Fees are as communicated to you at the time you subscribe. Subscriptions renew automatically for successive periods unless cancelled before renewal.
You may cancel at any time; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law. Usage beyond your plan's allowance is charged at the published overage rate.
We may change pricing on 30 days' notice by email. Continued use after a change constitutes acceptance.
All fees are exclusive of applicable taxes, including GST where payable.
Our handling of personal data is described in our Privacy Policy. Deletion is described on our Data Deletion page.
You retain ownership of your business content. You grant us a licence to process it solely to provide the Service.
You are responsible for having a lawful basis to process the personal data of people who contact you, and for meeting your own obligations to them under applicable data protection law.
We aim for continuous availability but do not guarantee it. The Service may be unavailable for maintenance, third-party failures, or circumstances beyond our control. We do not offer a service level agreement.
We may suspend or terminate your account if you breach these Terms, if your use creates legal or security risk, if payment fails, or if required by Meta or by law.
You may terminate at any time by deleting your account.
On termination, your data is deleted per our Data Deletion page. Sections 4, 13, 14, and 16 survive.
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI-generated content will always be accurate or appropriate.
To the maximum extent permitted by law, our total liability arising out of or relating to the Service will not exceed the amount you paid us in the three months preceding the event giving rise to the claim.
We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunity, even if advised of the possibility.
Nothing here excludes liability that cannot be excluded by law.
You will indemnify and hold harmless Ekamra Labs against claims arising from your use of the Service, your breach of these Terms, your violation of Meta's policies or any law, or the content of conversations conducted on your behalf.
These Terms are governed by the laws of India. The courts at Bengaluru have exclusive jurisdiction.
We may update these Terms. Material changes will be notified by email at least 14 days before taking effect. Continued use after that constitutes acceptance.
